1. Introduction

These Terms of Service ("Terms") govern your use of PulzHealth, a SaaS product byVerbsz Technologies Pvt Ltd ("Company", "we", "us"). PulzHealth includes two apps: PulzX (clinic dashboard) and MyMedQ (patient token booking).

By using our services, you agree to these Terms. If you do not agree, please do not use our platform.

2. Definitions

"Clinic": any healthcare provider, doctor's office, or medical practice using our services
"Patient": any individual booking a token or using MyMedQ
"Platform": PulzHealth website, PulzX dashboard, MyMedQ app, and related tools
"Token": a digital queue number issued to a patient for a clinic visit

3. Eligibility

Our clinic management services are available to registered medical practitioners and healthcare facilities in India. Patient-facing services (MyMedQ) are available to individuals aged 18 and above, or minors with guardian consent.

4. Services We Provide

Digital token/queue management for clinics
Patient-facing token booking via MyMedQ
Real-time queue status and estimated wait times
Clinic dashboard (PulzX) for managing daily operations
Notifications and communication tools

We are a technology platform. We do not provide medical advice, diagnosis, or treatment. We are not a healthcare provider.

5. Free Trial & Pricing

We offer a 3-month free trial for new clinics. No payment information is required to start. After the trial period:

We will notify you before the trial ends
Clinics are charged on a per-token basis. You pay only for patients marked as "Visited" during a session.
No-shows, cancellations, and unvisited tokens are not charged
You can choose to continue with the paid plan or cancel
Cancellation is available anytime with no penalties

MyMedQ is free for patients. There are no charges for booking tokens.

Pricing Changes

We reserve the right to modify pricing, including the per-token rate, promotional offers, and introductory discounts, at any time. Any pricing changes will be communicated via email at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated pricing. Promotional or introductory rates (e.g., launch offers) are temporary and may be revised or discontinued.

6. Clinic Responsibilities

As a clinic using PulzHealth, you agree to:

Provide accurate clinic and doctor information
Keep your queue status updated for patient accuracy
Not use the platform for any unlawful purpose
Comply with all applicable Indian healthcare regulations
Maintain valid medical registration as required by law
Handle patient data shared through the platform responsibly

7. Patient Responsibilities

As a patient using MyMedQ, you agree to:

Provide accurate contact information when booking
Arrive at the clinic around your estimated time
Cancel your token if you cannot attend, so others aren't affected
Not misuse the platform (e.g., booking multiple tokens you don't intend to use)

8. Intellectual Property

All content, branding, software, and technology on the PulzHealth platform are owned by Verbsz Technologies Pvt Ltd. You may not copy, modify, distribute, or reverse-engineer any part of our platform without written permission.

9. Limitation of Liability

We provide the platform "as is" without warranties of uninterrupted service
We are not liable for missed appointments, clinic delays, or medical outcomes
Our total liability is limited to the fees paid by you in the preceding 3 months
We are not responsible for third-party services (payment gateways, messaging platforms, etc.)

10. Termination

Either party can terminate the service at any time. Clinics can request cancellation by submitting a request through our support form. We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Upon termination, we will retain your data for up to 90 days for backup purposes, after which it will be permanently deleted unless required by law.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.

12. Indemnification

You agree to indemnify and hold harmless Verbsz Technologies Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms or misuse of the platform.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14. Compliance with Indian Law

Our services comply with:

Information Technology Act, 2000 and IT Rules
Digital Personal Data Protection Act, 2023 (DPDP Act)
Indian Contract Act, 1872
Consumer Protection Act, 2019
Applicable state-level healthcare regulations in Kerala

15. Disclaimer

The information on the PulzHealth platform is for general information purposes only. We assume no responsibility for errors or omissions. In no event shall PulzHealth be liable for any special, direct, indirect, consequential, or incidental damages arising from the use of our services. PulzHealth is a technology platform and does not provide medical advice.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices on the platform, constitute the entire agreement between you and Verbsz Technologies Pvt Ltd regarding your use of the platform, superseding all prior agreements.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 15 days before they take effect. Continued use of the platform after changes constitutes acceptance.
